You may not have noticed, but it looks like China will probably adopt a European stance on competition regulation. Part of it might have to do with the fact that the EU-China Trade Project is leading the charge for EU-style enforcement, also known as "competition for competitors' sake." The U.S., by contrast, focuses on protecting competition as a whole.
Maybe it's time we invested in translating our merger guidelines into Chinese, like the Europeans did. Or maybe we should give the Chinese government a study which examines the intersection of American antitrust and intellectual property law, like the EU did. Or maybe, just maybe, we should keep sitting on our hands and do nothing. And then, when we wake up, we'll realize what happened to American businesses abroad.
